Regardless of whether you are an existing customer, interested in our products and services or visiting our website www.bachmann.info for other reasons, your privacy and the integrity of your personal data are of utmost importance to Bachmann. For this reason, all entities of the Bachmann group of companies (hereafter referred to as “we”) hereby give an overview of the data we collect, the purposes for which we collect them, how they will be processed, and the measures we have taken to safeguard their integrity.

1. Whose data and which types of data will be processed?

This Privacy Statement concerns the personal data of natural persons who have contacted us through various channels. Collected data may then be assigned to individuals as they are known to us. Against this background, we collect the following types of data:

  • Identification and contact details, such as first and last name, email and postal address, telephone number, etc.
  • Information regarding your interests and preferences about our products and services;
  • Contracting and invoicing details: These are data which may be derived from existing contracts;
  • Information about your online-behavior and preferences; 
  • Audiovisual data, e.g., photos taken at trade fairs and other company events, videos recorded by cameras on our premises, etc.
  • Further types of similar data.

2. How will your data be processed?

The data collected will be – fully or partially automated – stored, arranged according to certain criteria, used, shared, forwarded and deleted. Processing also includes the provision and retrieval, comparison or linking of collected data.

3. For which purposes will your data be processed?

The purposes for which we process your data depends on how you have contacted us (e.g. by visiting our website), or which products and services you are supplied with in the context of an existing partnership.

Data may be processed for any of the following purposes: Advertising and marketing as well as general strengthening of our relationship, information (also on social media) about and improvement of our products and services, tailoring of offers, compliance with (pre-)contractual or statutory obligations, security measures designed for our premises and preparation of legal disputes.
  
4. On what legal basis do we process your data and for how long will they be stored?

You have voluntarily made your data available and they will be processed according to your consent; furthermore, we process some or all of your data in compliance with (pre-)contractual or statutory obligations or based on our legitimate interest. Your data, however, will not be stored for longer than what is absolutely necessary for the respective purpose or for as long as we are legally required to do so.

5. Who has access to your data?

We make collected data available only to employees who need them to fulfil their duties; other employees have no access to your data. Moreover, we may pass on some or all of your data to other entities within the Bachmann group of companies and to authorities to the extent this is a legal requirement. Finally, we cooperate with distributors and other external service providers, e.g. to send out our newsletter; in each case we ensure through contractual obligations that your data will only be processed in accordance with this statement as well as all applicable laws.

6. Which tools are we using to collect your data?

We use CCTV, voice recording instruments, cookies and other tools (e.g. software analysis) to efficiently collect and analyze relevant data. At the same time, we have taken state-of-the-art measures to protect collected data against unauthorized access or manipulation, and we have taken measures within our organization to ensure that the only employees who have access to your data are those who need them to fulfill their duties. Finally, it goes without saying that we are compliant with all applicable laws.  

7. Which tools do we use to analyze your data?

We use analytics tools ("cookies") to collect data about the behavior of visitors to our website. You will find more detailed information in our cookie settings. If you reject third-party cookies on our website, performance data will not be collected. This will not affect the functionality of our website. Data collected through third-party cookies has a maximum storage period of 13 months.

Even if you reject third-party cookies, necessary cookies will be active during your session. However, these so-called "first-party" cookies remain on your browser only for the duration of your visit to our website and are deleted immediately afterwards. These cookies are essential for the functionality of our website and will never be used for other purposes.

We also work with the following partners:

Matomo
We use "Matomo", an open-source and self-hosted software, to collect anonymous usage data about our website. We collect this data to help us troubleshoot any technical issues and to measure the effectiveness of our website and marketing campaigns.

If you accept third-party cookies, Matomo will process the following data:

  • Anonymized IP addresses, with the last two bytes of the IP address removed;
  • Referral websites or search engines and keywords;
  • Date, time and duration of the visit;
  • Visitor country, region, and city;
  • Visitor device and software (including browser language); 
  • Pages visited, including searches and downloads; 
  • Link clicks (internal and external);
  • Interactions with forms (but no content);

The data we collect using Matomo is processed exclusively by us. It is stored on our own server, which is located in Austria. The data collected through our website is hosted exclusively in Austria. Data never leaves the territory of the EU.

8. What are your statutory rights?

Your statutory rights are set out in the EU General Data Protection Regulation/GDPR as well as in any domestic data protection laws (e.g. the Austrian Data Protection Act or the German Federal Data Protection Act). On the basis of the GDPR you are entitled to the following:

  • Right of access by the data subject (Article 15),
  • Right of rectification (Article 16),
  • Right to erasure (‘right to be forgotten’) (Article 17),
  • Right of restriction of processing (Article 18),
  • Right of data portability (Article 20),
  • Right to object (Article 21).

Any consent declared vis-à-vis Bachmann may be withdrawn at any time by sending a simple statement to the following address privacy@bachmann.info. Please be aware that a withdrawal of a consent given does not affect the processing of any data which has taken place prior to the withdrawal of consent. Furthermore, a withdrawal may not be possible in some circumstances, e.g. when data are being processed in compliance with legal obligations.

9. You intend to apply for a vacancy – what will happen to your data?

We are delighted to receive job applications, regardless of by post, email or via the application tool on our website. All information disclosed in the course of the application process is handled with the same care as all other personal data and, in particular, will be stored in a file-system with restricted access.

Furthermore, you can be assured that your data will be available only to members of the central and/or local HR-department, as well as the relevant supervisor(s); please be aware that the central HR-department acts as a service provider for entities of the Bachmann group of companies, which sometimes requires information to be shared. When you apply for a position, we assume your consent to your data being kept in our records for any vacancy that may arise in the future; all these data will be automatically deleted in accordance with applicable law.

The data protection manager will respond to your matter immediately or, alternatively, inform you about long it will take to do so. Alternatively, or additionally, you may contact your national data protection authority.

11.  Will there be any changes to this Privacy Statement in the future?

The provisions of this Privacy Statement are currently up to date. However, we may need to update this Privacy Statement occasionally due to ongoing technical developments or changes in the law. The most recent version of this Privacy Statement will always be available from the menu item “Data Protection” on our website www.bachmann.info.
