Conditions of use and disclaimer of liability.

By viewing this website (www.bachmann.info and alternative addresses; hereinafter referred to as “BEsite”) you, as visitor, are accepting the following conditions of use which include a disclaimer of liability (“Conditions of Use”). The Conditions of Use may be viewed from each page of the BEsite.

The BEsite primarily intends to provide information about Bachmann electronic GmbH and its subsidiaries (“Bachmann”). We aim to publish content of high quality. We do not, however, accept liability for the correctness, up-to-dateness, objectivity and/or completeness of the information published on the BEsite. Accordingly, we do not accept any liability for direct or indirect damages resulting from the use of, including file downloads and installations, or reliance on the information provided on the BEsite. In the case of software being downloaded from the access-restricted customer area (menu item: “Customer Login”; the “Customer Area”), the liability provisions of the contract concluded between Bachmann and customer apply.

Although we undertake every effort to keep the BEsite and system hardware (servers, etc.) free of viruses and the like, we cannot guarantee the absence of viruses nor accept any liability for damages resulting therefrom; this disclaimer of liability applies to all pages of and all information provided on the BEsite. All visitors are obliged to scan for viruses and use other safety measures in order to limit potential damages and to prevent viruses from being passed onto the BEsite.

Bachmann reserves the right to discontinue at any time wholly or partly the provision of information via the BEsite and to change its content without further notice; similarly, the Conditions of Use may change from time to time and they apply in the version published on the BEsite whenever viewed by you. Due to the nature of the internet and computer systems Bachmann cannot guarantee that the BEsite is permanently or without interruptions available.

The BEsite may contain links to third party-websites. Bachmann disclaims any responsibility for the content of these websites and does not adopt them; this includes instances in which Bachmann makes a comment on the link or the link is part of an article on the BEsite. The content of linked websites is the sole responsibility of the respective author and provider. Links and other references to third party-websites shall not be construed as a recommendation by Bachmann.

Intellectual property rights for all content (including texts, pictures, trademarks, logos, etc.) which can be found on the BEsite remain with Bachmann to the extent it owns these rights.

The use of texts, pictures, programme code or design elements is permitted only upon the explicit and prior written consent by Bachmann; this applies also to the use of such materials in electronic form and both commercial and non-commercial usage. Beyond the Customer Area, you are exclusively entitled to view the BEsite and to make use of the information provided in a way and to the extent as covered by the information purpose of the BEsite.

The generally accessible pages of the BEsite contain non-binding information which in any case is not and will not become part of a business relationship.

Access data for the Customer Area of the BEsite as well as their content may be passed on only to such members of customer’s organisation with a “need to know” and not to any third party. In case customer suspects or has positive knowledge of a third party having obtained access data for the Customer Area, customer shall inform Bachmann immediately and in writing. Subsequently, Bachmann will suspend these access data and provide customer with new access data.

Bachmann reserves the right to use cookies. Personal data provided by viewers (if any) are used by Bachmann in accordance with the applicable data protection laws.

Bachmann is in no way obliged to publish articles or answer to enquiries sent to it by traditional or electronic mail. The decision to publish any article is subject to the editorial sovereignty of Bachmann and will not be explained or commented.

Austrian law (excluding its conflict of law rules) applies. Viewers who are accessing the BEsite from jurisdictions other than Austria are wholly responsible for compliance with the applicable rules and regulations of that jurisdiction. Place of jurisdiction is Feldkirch, Austria.
